Real Estate Agency Sues Development Company

The Client

A well-known commercial and residential development company in business for over a half-century.

The Problem

During the development of a residential project and prior to obtaining permits, the company entered into an exclusive contract with a real estate agency. It was agreed the agency would promote and sell the apartment units constructed at the project in exchange for commissions earned after the successful sale of the apartment units by deed. However, during the process of obtaining permits, the project was redesigned to conform with governmental demands, forcing the real estate agency to resell the units. Disgruntled, the real estate agency sued the company both for commissions earned as well as for damages.

Action Taken & Result

The company won the lawsuit. It prevailed on a motion for the summary judgment prepared by the attorney, which was subsequently upheld in appeal.
